The purpose of the privacy policy is to inform you in a clear and transparent way about the processing of personal data, as well as about the modalities in which the processing is carried out.

The VS Law Firm generally ensures that the collecting of personal data is adequate, relevant and necessary for the purposes of the processing (principle of minimisation). The Law Firm takes appropriate security and confidentiality measures to ensure the protection of personal data, including data protection issues from the outset and by default.

The VS Law Firm undertakes to comply with the provisions of the applicable regulations, in particular those of the EU Regulation n. 2016/679 on the protection of personal data, as well as those of any law or regulation supplementing it.

1. COLLECTED DATA AND METHODS OF COLLECTION.

Any information relating to an identified or identifiable individual constitutes a personal data.

Within the framework of its activities and the operation of its website, the VS Law Firm ensures that it only collects and processes data that is strictly necessary for the purpose envisaged.

The data likely to be collected when you use the site are the following ones:

  • when using the contact form: identity and contact information (surname, first name, e-mail address, telephone number, information from the message sent);
  • when you use the services of the Law Firm: all information necessary for the performance of the assignment entrusted to the Firm, including identification and contact data, as well as financial and billing data (name, first name, e-mail address, telephone number, payment methods, etc.).

 

The Law Firm may receive personal data from third parties, in the context of its legal obligations or in the performance of its mission, and in particular:

  • administrative and supervisory authorities;
  • judicial authorities;
  • its clients, in the context of the assignments entrusted to it;
  • its partners.

The Law Firm draws your attention to the fact that you are free to consent or refuse the use of cookies at any time during your visit to the website, by clicking on the tab at the bottom right “Manage my consent”.

Furthermore, the Law Firm wishes to inform you that it does not collect any sensitive data (i.e. any information concerning a person’s racial or ethnic origin, political, philosophical or religious opinions, trade union membership, health or sex life), unless this is required by legal or regulatory provisions or it is strictly necessary for the performance of the assignment entrusted to it.

 

2. LEGAL BASIS FOR PROCESSING DATA.

The VS Law Firm ensures that it only processes your data in the cases provided for by the applicable regulations, and in particular :

  • on the basis of your free, specific, informed and unambiguous consent. Where applicable, you have the right to withdraw your consent at any time, which does not affect the lawfulness of the processing carried out prior to such withdrawal;
  • where the processing is necessary for the performance of a contract or pre-contractual measures taken at your request (e.g. taking over a file);
  • to comply with the Firm’s legal or regulatory obligations (e.g. the fight against fraud);
  • when the processing is justified by the legitimate interests of the Firm (e.g. informatic security measures, commercial prospecting).

 

3.  PURPOSE OF PROCESSING DATA.

The collection of your personal data is carried out by the VS Law Firm for specific, explicit and legitimate purposes, namely:

  • the handling, management and follow-up of cases entrusted to us;
  • the management of your relationship with the firm;
  • the processing of contact requests;
  • the respect of the deontological, legal and regulatory obligations incumbent on the lawyer;
  • representing and defending the client before the judicial and administrative authorities.

 

4. DURATION OF DATA RETENTION.

The VS Law Firm retains your personal data for the time strictly necessary to achieve the purposes for which they were collected, except the legal obligations to retain certain data or the legal possibilities of archiving and anonymisation.

The data obtained for the purposes of carrying out the mission entrusted to the Firm and within the framework of the mandate are kept for ten years from the end of the mission. After the expiry of this period, the data will be deleted.

However, archiving may be envisaged, on paper and secure electronic form, beyond the periods provided for, for research purposes.

 

5. RECIPIENTS OF THE COLLECTED DATA.

In accordance with the regulations in force, the collected data may be transmitted to the competent authorities upon request, and in particular to public organisms, judicial officers, public accountants, in order to comply with legal obligations.

If strictly necessary, data may also be transmitted to European Union bodies and to professionals acting in other States (EU members States or third parties).

If requested and under your consent, the Firm will only transmit to such third parties the data strictly necessary to fulfil their obligations.

 

6. STORAGE PLACE AND POSSIBLE TRANSFER OF DATA.

The personal data collected in the context of the mandate, via the contact form, or exchanges are stored on servers located in Italy.

In the event that, in order to carry out the mandate, it is necessary to transfer data, the Firm shall ensure that such transfer – particularly outside the European Union – is secure and shall obtain your prior consent.

 

7. RIGHTS OF THE CONCERNED PERSON AND HOW TO EXERCISE THEM.

Within the limits provided by the regulations in force, you have the following rights:

Right of access

You may consult the information processed by the VS Law Firm and receive a copy in paper or electronic form.

Right rectification

You may correct or complete inaccurate data concerning you in relation to the purpose of the processing.

Right to deleting data

You have the right to ask the VS Law Firm to delete your personal data, under certain conditions and subject to the exceptions provided for by the applicable law (legal and ethical obligations in particular).

Right to limit processing

You may request the limitation of the processing of your data when you dispute its accuracy or object to its processing. In this case, the Law Firm will have to examine your request, during which time you may ask it to freeze the use of your data. Conversely, you may request that the processing of certain data be restricted if the Law Firm wishes to delete them. This will allow you to keep the data, for example in order to exercise a right.

Right to data portability

Where processing is based on your consent or on an agreement, you may receive the personal data you have provided in a structured and commonly used format, in order to transmit that data to another controller. If possible, you may request the direct transfer of such data by the VS Law Firm to the new controller you have chosen.

Right to object to processing

You may object to your data being used by the VS Law Firm for a specific purpose, giving reasons based on your particular situation.

You may withdraw your consent to the processing of your personal data at any time. This will not affect the lawfulness of the processing carried out prior to such withdrawal.

8. CHANGES TO THE PRIVACY NOTICE.

The VS Law Firm reserves the right to modify this privacy notice from time to time in order to comply with any regulatory, legal, editorial or technical developments.

If necessary, the date of the update will be modified. The Firm invites you to consult the privacy policy regularly in order to take note of any changes that may have occurred.
